These terms are the agreement between you and localmkr for using localmkr. We wrote them to be understood. Read them together with the Privacy Policy, which explains what data we process and why, and, if you are a partner, with the Partner Program rules (§11).
In short
- localmkr builds your business's page in seconds, gives you the system for your trade and an agent, mkr, that works your business. Makers use it to serve their own clients.
- What you upload is yours. You give us permission to host it and show it, only to provide the service.
- What AI generates can be wrong: review it before you publish it. On localmkr, prices, opinions and testimonials are never invented.
- Paid plans renew every month. You cancel whenever you want and the plan runs until the end of the paid month. There is no proration.
- mkr leaves a receipt for what it does, and its changes can be undone. If someone uses it to abuse, the third strike brings a warning and the seventh closes a free account.
- A maker and its client have their own agreement: the maker sets its price and charges its client directly. localmkr is not a party to that agreement.
- We do not promise income, clients or a place on Google.
This summary helps you read; what counts is the full text.
1. Who we are and what these terms cover
1.1. localmkr is a service of SAASCODE, LLC, a limited liability company (LLC) formed in the State of Delaware, USA, with its address at 131 Continental Dr, Suite 305, Newark, DE 19713, USA ("localmkr", "we", "us").
1.2. These terms apply to everything we offer under the localmkr brand: the localmkr.com site and its app, the pages published on localmkr.page or on a custom domain connected to localmkr, the mkr agent, the trade system, the maker tools, the AI studio, credits, and the Partner Program (which also has its own rules, §11).
1.3. You accept these terms when you create an account, publish a page or buy a plan, and, if you have no account, when you use the app. If you use localmkr on behalf of a business or a maker, you confirm that you can bind them to these terms; in that case "you" includes them too.
1.4. If you do not agree with these terms, do not use localmkr.
1.5. These terms are in Spanish and in English. If the two versions differ, the version in the language in which you accepted them prevails.
2. Who is who
2.1. In these terms:
- Business: a business that uses localmkr with its own account (a direct account). It does everything on its own, with mkr.
- Maker: a person or company that uses localmkr to serve other people's businesses, with the power of an agency: it builds their page, system and marketing, and charges them for its work. Any account can turn on maker mode.
- Maker client: the business a maker serves on localmkr, and the people of that business the maker invites in. It runs its day: it sees its page, handles orders, bookings and contacts, and sees its reports; mkr handles the day-to-day for it. It asks its team (the maker) through mkr for design, marketing and changes to the system, and the maker does them.
- Partner: someone who takes part in the Partner Program with their link or code (§11).
- Visitor: someone who uses localmkr.com or the app without an account (for example, to build a trial page), or who visits a published page.
- End customer: the person who buys from, books with, writes to or leaves a review for a business through its page or its system on localmkr.
- mkr: localmkr's agent, which talks with you and works on your account with tools (§8).
- Your content: what you upload, write, paste or import into localmkr, and what localmkr generates for you at your request (§6 and §7).
2.2. The maker and its client. The relationship between a maker and its client is theirs. The maker sets its price, charges its client directly and answers to it for its work. localmkr is not a party to that agreement, does not charge on the maker's behalf and does not step into their disputes. The maker pays localmkr our prices (§4) and gets no commission or discount for reselling.
2.3. The maker is independent: it is not localmkr's employee, agent or representative, and it cannot promise anything on our behalf. Before it creates, publishes or changes a business's page or system, or processes the data of its end customers, it must have that business's authorization.
2.4. If a maker stops serving a business, the business can write to us to continue with its page and its data as a direct account.
2.5. A maker's client sees the maker as "Your team" and does not see the prices the maker pays localmkr.
3. Your account
3.1. Age. To have an account you must be of legal age in your country and at least 18 years old. localmkr is not meant for minors.
3.2. How you sign in. You sign in with a 6-digit code we send you by email; there is no password. Protect access to your email: whoever has it can get into your account. You are responsible for what is done from your account, including what your team does.
3.3. Real information. Your account and business details must be real and up to date.
3.4. Without an account. You can build a page without an account: it stays tied to your browser. To save it, publish it and come back to it you need an account. When you sign in, the pages you built in that browser move to your account.
3.5. Your team. With the Pro plan you can add up to 3 people to your business. You answer for what they do.
3.6. You may not open new accounts to get around a limit, a pause or a closure (§9).
4. Plans, prices and billing
4.1. The plans. Prices are in U.S. dollars and do not include taxes (§4.5).
| Plan | For | What it includes | Price |
|---|---|---|---|
| Free | Business | Your page on yourbusiness.localmkr.page with the «Hecho con localmkr» ("Made with localmkr") badge, the basic system for your trade, mkr up to 40 messages a day, social media pieces, reviews and manual payments | US$ 0 |
| Pro | Business, or the maker for its client | Everything in Free, plus: mkr with no daily message cap, changing the system by talking to mkr, online payments, automations, SEO, AI photos with a monthly allowance, 20 studio credits a month, custom domain, no badge and a team of up to 3 people | US$ 15 a month |
| Maker | Maker | Unlimited clients and prospects, importing your own list, 3 business searches a month, and your brand on proposals and reports | US$ 0, plus US$ 15 a month for each active client |
| Maker Pro | Maker | Everything in Maker, plus: 20 searches and 20 signals a month, the maker's own domain, pro templates and the AI marketing studio (credits are bought separately) | US$ 29 a month |
| AI studio credits | Business or maker | Packs of 50, 150 or 500 credits | US$ 5, US$ 14 or US$ 45 |
4.2. What each plan includes. The app's Plan screen shows what each plan includes. Anything the app marks «Pronto» or «Próximamente» ("Coming soon") is not part of what you pay for. Extra searches and other products are sold only when the app shows their price.
4.3. Active client. An active client is a business that is a maker's client, with its page published and its US$ 15 month paid. The first month is charged when the client's page is published, and then each month it stays active. The price is the same whether the maker or the business itself pays it.
4.4. How billing works. You pay by card through Stripe, or with PayPal, on each one's payment page. localmkr does not see or store your card number. Plans renew automatically every month, with the same payment method, until you cancel them. The app has the receipt for each payment; that receipt is not a tax invoice in your country.
4.5. Taxes. Prices do not include the taxes that apply in your country. If any must be added, you see it on the payment page before you pay. Your bank's charges for paying in dollars or converting currency are yours.
4.6. Cancelling or changing plans. You can cancel the renewal whenever you want from the Plan screen. The plan runs until the end of the paid period and then does not renew. There is no proration: we do not refund the part of the month you did not use. If you change plans, the new plan starts with a full month. With PayPal, a cancelled renewal cannot be resumed: when the period ends, you subscribe again.
4.7. Refunds. Except as your country's law provides, payments are not refunded. If we charge you by mistake (for example, twice for the same thing), we refund the overcharge. If your country's law gives you a right of withdrawal, we honor it: write to us within that period.
4.8. AI studio credits.
- They are sold only when the AI studio is available on your account.
- Only the credits for what was generated are deducted. If a generation fails, its credits go back to your balance.
- The 20 monthly credits of the Pro plan expire at the end of each month. Purchased and gift credits do not expire.
- Credits are not money: they cannot be exchanged for money, transferred to another account, or earn interest.
- Used credits are not refunded. A pack of which you used no credits is refunded if you ask within 14 days of the purchase.
4.9. Price changes. We may change prices. We will tell you by email or in the app at least 30 days in advance, and the new price applies from the first renewal after that period. If you do not agree, you can cancel before then.
4.10. If payment fails. If a renewal cannot be charged, the plan ends when the paid period ends (the payment provider may retry the charge under its own rules). Then:
- a business goes back to the Free plan: its page stays online with the badge, and the features of the Pro plan stop being available;
- a maker on Maker Pro goes back to the Maker plan;
- the page of a maker's client whose month is unpaid may be paused: it goes offline until it is paid. Its data is kept for 90 days and comes back as it was once paid.
5. Acceptable use
5.1. Use localmkr only for real businesses and lawful purposes. You may not use it to:
- publish illegal content, or sell products or services that are prohibited in your country or in your end customers' country;
- deceive: false prices, offers, data, titles, awards or results; invented, bought or filtered reviews or testimonials; AI-generated people presented as real customers;
- impersonate another person or business, or publish the page of a business you do not represent without its authorization;
- send spam: mass or automated messages, or contacts that your country's law or the recipient's does not allow;
- harass, threaten, discriminate or incite hatred or violence; publish sexually explicit content, or any sexual content involving minors;
- infringe other people's copyright, trademarks, image or privacy;
- distribute malware, phish, or collect people's data without their permission;
- attack, overload or probe localmkr's security, get around its limits, or extract its data with automated programs;
- use mkr as a general assistant for things that have nothing to do with your business (§9).
5.2. If your business is in a regulated activity (health, food, alcohol, finance or others), complying with its rules is your responsibility.
5.3. We may remove content or pause a page that breaks these rules or the law. We will tell you when possible.
6. Your content
6.1. It is yours. What you upload, write, paste or import into localmkr remains yours (or belongs to whoever licensed it to you). What localmkr generates for you at your request is also yours, as far as it depends on us (§7.4).
6.2. The permission you give us. You give us a worldwide, non-exclusive, royalty-free permission to host, copy, adapt (for example, resize or reformat a photo), display and publish your content, only to provide the service: to build and show your page, run your system, let mkr work and let your end customers see what you publish. The permission lasts while your content is on localmkr and for the time we need to delete it (Privacy Policy). What you publish on your page is public: anyone can see it.
6.3. Examples and advertising. We do not use your page or your business's name in localmkr's advertising without your permission.
6.4. What you guarantee. When you upload or import content (for example, when you paste your old website or your Instagram so localmkr takes your colors, logo and photos), you guarantee that it is yours or that you have permission to use it that way, and that doing so does not break the law or anyone's rights. If a person appears in a photo, you must have their permission.
6.5. What is ours. The software, the engine that builds the pages, the templates, the designs, the app's texts, the localmkr brand and mkr belong to localmkr or to those who license them to us. While you use localmkr you may use them for your page and your business. You may not copy them for another service, sell them separately or remove their notices. If you send us ideas or feedback, we may use them with no obligation to you.
6.6. Rights claims. If you believe something published with localmkr infringes your rights, write to [email protected] with who you are, which right it is, where it is (the link) and why. We review it and, where appropriate, remove it and tell whoever published it, who can answer the claim at the same address.
7. AI-generated content
7.1. localmkr uses third-party AI models to build pages, write texts, converse (mkr), prepare drafts and generate images and videos (the studio).
7.2. It can be wrong. What AI generates can be inaccurate or incomplete, or not fit your case. Review it before you publish it, send it or use it. You are responsible for what you publish and send, even if mkr wrote it.
7.3. Only what is real. localmkr is built not to invent: it does not put in prices, phone numbers, hours or opinions that you did not give it or that do not come from your sources; if a piece of information is missing, it leaves it empty or asks you. We ask the same of you:
- no invented testimonials, reviews, customers, figures or achievements;
- an AI-generated person, voice or face is presented as what it is, never as a real customer or employee;
- do not generate images of real people without their permission, or images that show them in situations that did not happen.
7.4. AI-generated content may not be protected by copyright in your country, and AI may generate similar results for other people. We do not guarantee that what is generated does not resemble third-party works.
7.5. Reference prices, diagnoses, reports and drafts are for guidance. They are not legal, accounting, tax or professional advice.
8. mkr, the agent
8.1. mkr talks with you and works on your account with tools: your page, your data, your sales and bookings, your customers, your apps, your marketing, your SEO, your reports, your system and, if you are a maker, your prospects.
8.2. Receipt and undo. mkr acts only with tools that leave a receipt of what it did, and the changes it makes to your page and your system can be undone from the app. mkr does not say it did something if it does not have the receipt.
8.3. What it does not do without you. mkr does not send messages, emails or posts to other people on your behalf unless you turn that on. You send the drafts for your customers and your prospects.
8.4. Memory. mkr remembers what you talked about for each business, so it does not ask you the same thing twice. You can ask it to forget (Privacy Policy, §4.3).
8.5. Limits. On the Free plan, mkr answers up to 40 messages a day; whatever is answered without using an AI model does not count. Paid plans have no daily message cap, but they do have reasonable usage limits to protect the service.
8.6. You decide: review what mkr does and undo it if it does not work for you.
9. The guard and closure for misuse
9.1. Before mkr answers, an automated system, the guard, reads the message together with the last turns of the conversation and decides whether it is about your business, something unrelated, abuse or trolling. Greetings and very short messages are not judged. Venting about a bad day or about a customer is not abuse.
9.2. What counts as a strike.
- Something unrelated to the business (homework, code, texts for other people, passing the time): the first 3 of the day just bring you back to the business; from the fourth of the day on, each one is a strike.
- Abuse: insults, contempt or threats against mkr, against localmkr or against a person; harassment; hateful, sexual or violent content; asking for something illegal, or for something to deceive or harm someone.
- Trolling: tricks to make mkr say something absurd or offensive, asking for its instructions or asking it to ignore them.
9.3. What happens. Strikes count for 7 days. On the third, mkr warns you. On the seventh:
- a free account is closed for misuse;
- a paid account or a maker goes 24 hours without mkr.
9.4. What closure means. The whole account is blocked: the app shows only the closure screen, nothing can be edited, published or built, and its published pages go offline. If a visitor without an account is abusive, that chat is cut.
9.5. The device mark. With each message it flags, the guard keeps an encrypted mark of the device and the network it was written from. When an account is closed, that mark keeps it from coming back with another account: a new account or a new page from that device is blocked too. What is kept, why, for how long and how to ask for a review is in the Privacy Policy, §4.10.
9.6. If you think it was a mistake. The closure screen has «Escribir a soporte» ("Write to support"). A person on the localmkr team reads the request and, if the guard got it wrong, reverses the closure: the strikes are cleared, and the account and its pages come back as they were. You can send one request every 10 minutes, up to 3 a day. We answer within 5 business days.
9.7. Other suspensions. Besides the guard, we may suspend or close an account that seriously breaks these terms (fraud, illegal content, abusing other people, fraudulent payments) or when the law requires it. We will tell you and say why, unless the law or security prevents it.
10. Makers: business search, proposals and contact
10.1. The search. With business search, a maker finds businesses by trade and area. It uses only public business data: its Google Maps listing (through Apify), its website, its public Instagram and other public sources, such as Meta's ad library or public web archives, to tell whether it advertises or how old its website is. It is built to keep the business's contact details, not the personal details of the people who work there, and it does not keep the text or the authors of its reviews. A business that is found is reserved for your maker account for 14 days.
10.2. What it is for. Only to offer your services to that business. You may not sell or pass the list to others, or use it for anything else.
10.3. Proposals. You can rebuild a prospect's website and show it to them in a proposal with a private link. The proposal uses the business's public material (its name, logo, photos and texts) only to show it to that business. Do not publish it as if it were the business's page or show it to others without its authorization, and delete it if the business asks you to. We record whether the proposal was opened, so you know.
10.4. Contact. localmkr prepares email, WhatsApp and call drafts with the contact rules it knows for each country. For example: in Argentina the subject of a commercial email starts with «PUBLICIDAD»; in Spain you may not write to a business without its prior consent, so it does not prepare cold messages; in Peru the first contact only asks for permission; in Mexico and Colombia you write to the business's email. Each draft says who is writing, where the data came from and how to ask not to be contacted again. You send the drafts, never localmkr. You are responsible for complying with the commercial contact and data laws of your country and of the business's country, for respecting anyone who asks not to be contacted again, and for not sending mass or automated messages.
10.5. What you never promise. Neither in your messages nor in your proposals do you promise sales, income, clients or a place on Google on localmkr's behalf.
10.6. Your clients. When you add a client you confirm that it authorized you to manage its page, its system and its end customers' data, and that you explained to it what localmkr does. The reports with your brand, your invoices to your client and your prices are yours.
10.7. Reference prices. The reference prices in «El oficio» ("The trade") carry their source and are for guidance: check them before you use them.
11. Partner Program, sharing credits and the badge
11.1. The Partner Program. A partner earns 20 % of the US$ 15 a month of each active business of the makers they invite, for as long as that business pays. A maker is attributed to a partner through their link or code: first touch counts, for 30 days, and only for new accounts. A commission is approved 30 days after the business's payment, and approved commissions are paid at the end of each month, through PayPal, once they add up to at least US$ 25. In every piece you publish you must say that it is advertising and that you earn a commission. You may not promise income, show invented results or use false testimonials. The program has its own rules, which you receive when you join; by sharing your link you accept them. Where they contradict these terms on something about the program, the program's rules prevail.
11.2. The badge. Free plan pages carry the «Hecho con localmkr» ("Made with localmkr") badge, with a link to localmkr that carries your invitation. You may not remove, cover or change it. The Pro plan removes it.
11.3. Sharing credits. If a business comes to localmkr through your link or your badge and publishes its page, you may receive studio credits, in the amount and up to the cap the app shows. When you share what you built to earn credits, say that it is your invitation link. Your own, duplicate or fake accounts do not count.
12. Sales, bookings and your end customers' data
12.1. What you sell to, book with or charge your end customers is between you and them. localmkr is not a party to those sales: it does not sell, deliver or guarantee your products or services, and it is not responsible for your prices, deliveries, returns or obligations to consumers.
12.2. Your end customers' data. The business is the controller of its end customers' data (orders, bookings, contacts, reviews, payments). If a maker serves it, the maker acts on the business's behalf. localmkr processes that data on their behalf, as a processor, under section 5 of the Privacy Policy, which is part of these terms. You must have a legal basis to process that data, inform your end customers (for example, with your own privacy notice) and handle their requests about their data; we help you with what the app allows.
12.3. Reviews. The reviews on your page must come from real customers. Do not invent them, buy them or hide negative ones just because they are negative.
12.4. Charging your customers. Payments from your end customers are recorded by hand (cash, bank transfer, cash on delivery). Online payments, where the app offers them, have their own terms, which you see when you turn them on.
13. Third-party services and integrations
13.1. localmkr runs on third-party services: payments, hosting, email, AI models and public data sources. The list is in the Privacy Policy. When you pay with Stripe or PayPal, you also accept their terms.
13.2. The integrations with WhatsApp, Instagram, Messenger and Google Business Profile, and automatic ads, work only if you connect your own account, under that platform's terms, and you can disconnect it whenever you want.
13.3. We are not responsible for third-party services, or for their changes or outages.
14. Availability and changes to the service
14.1. We do our best to keep localmkr working at all times, but we do not guarantee that it will be free of outages, errors or data loss. There may be maintenance. Keep a copy of whatever is important to you (photos, texts, data).
14.2. localmkr changes often: we may add, change or remove features. If we remove something essential from a paid plan, we will tell you in advance and you can cancel.
14.3. Features marked «Próximamente» ("Coming soon") or "in testing" may change or may not arrive.
15. Closing your account
15.1. You can stop using localmkr whenever you want. To close your account and delete your data, cancel any paid plans and write to us from your account's email (the steps are in the Privacy Policy, "How to delete your data"). When it is closed, your pages go offline and your data is deleted as the Privacy Policy says.
15.2. We may close your account for the reasons in §9.
15.3. Whatever by its nature must survive closure (outstanding payments, your content, liability, indemnity, governing law) survives.
16. Warranties and liability
16.1. No promise of results. localmkr is a tool. We do not guarantee sales, income, clients, bookings or a place on Google or any other search engine, to a business or to a maker. Income examples you see on localmkr or from our partners are hypothetical, unless they say otherwise.
16.2. As is. To the extent the law allows, localmkr is provided "as is" and "as available", without implied warranties of merchantability, fitness for a particular purpose or non-infringement.
16.3. Cap. To the extent the law allows: (a) we are not liable for indirect damages, lost profits, or loss of data, customers or opportunities; (b) our total liability for any claim related to localmkr does not exceed what you paid us in the 12 months before the claim, or US$ 100 if you paid nothing.
16.4. What the law does not allow us to limit. Nothing in these terms limits the rights your country's law gives you that cannot be waived (for example, as a consumer), or our liability for willful misconduct or gross negligence.
17. Indemnity
If someone makes a claim against us because of your content, how you used localmkr, your relationship with your clients, your end customers or your prospects, or because you broke these terms or the law, you take responsibility and hold us harmless, including reasonable attorneys' fees, to the extent the law allows.
18. Governing law and jurisdiction
These terms are governed by the laws of the State of Delaware, USA, and claims are resolved in the state or federal courts located in Delaware, unless your country's law gives you the right to bring a claim before your own courts or under your own law, as happens with consumers in many countries. Before bringing a claim, write to us: we try to resolve it within 30 days.
19. Changes to these terms
We may change these terms. If the change is significant, we will tell you by email or in the app at least 30 days before it takes effect. If you keep using localmkr afterwards, you accept the new version; if you do not agree, you can cancel and close your account. The version date is at the top.
20. Other terms
- These terms, the Privacy Policy and the Partner Program rules are the entire agreement between you and localmkr about localmkr.
- If one provision is invalid, the rest remains valid.
- Not enforcing a provision once does not mean we waive it.
- You may not assign your account or these terms without our permission. We may assign them if the company changes hands or form (for example, if the LLC becomes another kind of company); we will tell you.
- We are not liable for delays or failures caused by events beyond our reasonable control.
- We may give you notice by email or in the app; those notices count as written notice.
